Welcome to SimpleSwap. By accessing, browsing, or using the .io website, mobile application, or any associated services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. These Terms constitute a legally binding agreement between you and SimpleSwap governing your use of our cryptocurrency exchange platform.

1. Acceptance of Terms

If you do not agree with any part of these Terms of Use, you must immediately discontinue your use of the .io platform and services. Continued use of our Services constitutes ongoing acceptance of these Terms and any future modifications.

2. Our Services

SimpleSwap provides a non-custodial cryptocurrency exchange platform that enables users to swap between various digital assets. Our Services include instant exchanges between 900+ digital assets, fixed and floating rate options, real-time transaction tracking, optional user account features, 24/7 support, and educational resources. All transactions occur directly between user wallets without storing funds on our platform.

3. Eligibility

To use SimpleSwap Services, you must be at least 18 years old (or the age of majority in your jurisdiction), have legal capacity to enter contracts, not reside in restricted jurisdictions, not be subject to sanctions, and not use our Services for illegal purposes. SimpleSwap reserves the right to refuse service at our discretion.

4. User Responsibilities

Users are responsible for wallet security, verifying transactions before confirming, complying with all applicable laws, and providing accurate account information.

5. Prohibited Activities

Users may not engage in money laundering, fraud, unauthorized access, market manipulation, malware distribution, or other illegal activities. SimpleSwap monitors activity and may suspend or terminate accounts as needed.

6. Fees and Charges

SimpleSwap charges transparent service fees included in exchange rates. Network fees are separate. All fees are final once a transaction is initiated. Registered users may receive occasional discounts or promotions.

7. Intellectual Property

All content on .io, including text, graphics, logos, images, software, and design, is the exclusive property of SimpleSwap and protected by copyright and trademark laws. Users have a limited, non-transferable license for personal, non-commercial use.

8. Limitation of Liability

SimpleSwap and its affiliates are not liable for indirect, incidental, or consequential damages resulting from use of our Services. Aggregate liability is limited to $100 or the amount paid for the Services in the past six months.

9. Indemnification

Users agree to indemnify SimpleSwap and its affiliates from claims, damages, or expenses arising from violation of Terms or misuse of the Services.

10. Termination

SimpleSwap may suspend or terminate access to the Services at our discretion. Upon termination, all provisions meant to survive termination, such as ownership, disclaimers, and indemnity, remain effective.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Estonia. Legal proceedings must be brought exclusively in Estonian courts. Users waive objections to jurisdiction and venue.

12. Changes to Terms

SimpleSwap may modify these Terms at any time. Material changes will be notified at least 30 days in advance. Continued use after changes constitutes acceptance of new terms.
